Terms of Service
Effective May 8, 2026.
These Terms of Service (“Terms”) govern your use of the QalaMishkat website at qalamishkat.com and the related applications (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
QalaMishkat is an educational eLearning platform for teaching Tajweed, memorization (Hifz), and understanding (Tafsir) of the Quran. It is operated as a project of the dawasite ecosystem and contactable at partakeinprogress@gmail.com. The Service is currently offered free of charge.
2. Eligibility
You must be at least 13 years old to create an account. If you are between 13 and 18, we recommend that a parent or guardian helps you sign up. By creating an account you represent that the information you provide is accurate and that you are legally able to enter into these Terms.
3. Accounts
You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately if you believe your account has been used without your permission. One person, one account: do not share account credentials with others.
Roles in the Service are student, teacher, and admin. Admin accounts are assigned only by an existing admin. Self-serve sign-up does not allow elevation to admin.
4. Acceptable use
In using the Service, you agree NOT to:
- Modify, distort, or misrepresent the text of the Quran. Quranic text presented through the Service comes from authoritative sources and must remain unaltered.
- Republish or redistribute Quranic text, recitations, translations, or tafsirs in ways that violate the licenses we operate under (Tanzil, Quran.Foundation, QuranEnc, and the per-reciter terms).
- Use the Service to harass, defame, or expose private information about another person.
- Attempt to disrupt the Service, probe for vulnerabilities (without our written consent), or circumvent rate limits, authentication, or access controls.
- Use the Service to operate competing platforms by scraping our curated content, learning records, or AI-generated suggestions in bulk.
- Upload material that infringes intellectual property rights, that is unlawful, or that contains malware.
5. Quranic content and tradition
The Quran is the inviolable speech of Allah. The Service is a teaching tool, not a substitute for an authoritative scholar. AI features are designed to assist teachers in lesson preparation and must always be reviewed before being presented to students. We label AI suggestions as such, distinguish verified corpus data from training-derived reference notes, and encourage you to consult qualified scholars and authoritative mushafs for ruling on disputed tajweed cases or recitation-style exceptions.
6. Intellectual property
QalaMishkat, the QalaMishkat name and visual identity, the application code (except where covered by an open-source license), and our curated content remain our property or that of our licensors. You retain ownership of the original content you create through the Service (your class designs, your lesson configurations). By using the Service you grant us a worldwide, non-exclusive, royalty-free license to host, display, and process that content as necessary to operate the Service for you.
Quranic text, audio recordings of recitation, translations, and tafsirs are made available through licenses from their originators and remain their property. We attribute Quran.com / Quran.Foundation and the underlying source projects (Tanzil, QuranEnc, KFGQPC) where applicable.
7. AI features
The “Generate with AI” feature uses Anthropic’s Claude model to assist teachers. Outputs are suggestions and may contain errors despite our safeguards. You agree to review and verify AI suggestions before relying on them, especially with respect to Quranic content. We do not represent that AI outputs are theologically authoritative.
8. Privacy
Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.
9. Termination
You may stop using the Service at any time and request deletion of your account by emailing partakeinprogress@gmail.com. We may suspend or terminate your account if you violate these Terms or if continued access poses a risk to the Service or to other users. We will give reasonable notice where we can; in cases of clear abuse we may act without notice.
10. Disclaimers and limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, in no event will QalaMishkat or its operators be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.
11. Indemnification
You agree to indemnify and hold harmless QalaMishkat and its operators from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.
12. Governing law and venue
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. The exclusive venue for any dispute arising under these Terms is the state and federal courts located in Dallas County, Texas.
13. Changes
We may update these Terms from time to time. The “Effective” date at the top shows when the most recent version took effect. Material changes will be announced in the application or by email. Continued use of the Service after a change takes effect constitutes acceptance of the new Terms.
